Preying on drunk women in social settings = rape?

    I was reading up about Tucker Max on wikipedia yesterday, more specifically the books his website/blog has spawned and the feature film that was based on his first best seller I Hope They Serve Beer in Hell.

    It was interesting to read that at signings and other promotional apperances that feminist groups had picketed them, accusing his material of "promoting a culture of rape".

    I'm finding it hard to settle on what's the "right" viewpoint here. On one hand, it's true that drunk women clearly don't have full use of their rationale and taking advantage of that is cheap; on the other, if they're drinking out at bars and engaging men, it wouldn't be a big leap to say that maybe they want to drink and are maybe open to having sex with somebody. It's not a certified conclusion but it's a possibility, and this is in no way condoning unwarranted sexual assault in any way.
    I'm overall unsure if for women there's a danger of a "no" turning into a "yes" just through intoxication. Yes, drinking lowers morals, but I find it hard to believe that you'd do something you REALLY didn't want to do just because you're tanked. If you're too wiped to even be coherent and vocalise an opinion, that's a different story.
    I can't say I've even done something I really didn't want to do beforehand through drinking, but of course, that's just me.

    I've taken many regrettable decisions while drunk that would have been quite different had I been sober.

    I can't speak for women for obvious reasons, and for all men for that matter, just for myself. But I've done things while very drunk that I would have thought twice about if sober. However, I can't recall (or rather, have other people recall for me) doing something that I would definitely never do when sober. Everything I've done drunk is within the realm of possibilities of things I would do sober, just getting rid of some inhibitions.

    This topic hits close to home specially now that I live in the UK. Almost everyone I know that is Scottish / from the UK itself here get laid ONLY by being drunk and picking up drunk chicks. I know a few friends from back in high school who are 'Pick-Up Artists' (it's such a lame term, and some are more succesful than others, but having seen one in action, there is definitely something about the 'formula' that he uses that works) that can pick up chicks sober easily, but here, people (guys) pretty much assume that the woman has to be drunk to fuck them. It's borderline pathetic to be honest, and it depresses me to no end because there is nothing more unattractive than seeing a chick who can barely stand. One of my friends here is the most hypocritical guy I know, cool guy to hang out with but he talks so much shit. The ONLY times he's gotten laid was when he was drunk and he picked up some ridiculously drunk girls. But when he wants to get on the good side of our 'international' female friends (you know, women that actually respect themselves), he always talks about how the most unattractive thing is seeing a woman that is so fucked up she can barely speak.

    It's funny and depressing at the same time.

    Just to argue the point, whose to say its not the guying being taken advantage of while in this intoxicated state?

    Should a guy be fucking a girl who is passed out drunk on a bench? Hell no. On the other hand, if she is all over him and they go home and have sex -- if she regretted in the morning, a woman would be adult to admit her own part in that nights events and move on with life.

    It really depends on how drunk she is. There's a point when you're drinking where you do lose the ability to rationally consent to pretty much anything. That's assuming you even realize what is going on. And it takes less alcohol to get a woman to that point.

    Personally if I swung that way I'd steer clear of going after overly drunk chicks if only for the legal ramifications - if she regrets it enough and is unethical enough she can cry rape and basically fuck your life.

    If she is passed out and a guy fucks her without consent it's rape.

    If she consents but it's because of being threatened, blackmailed, or coerced it's rape.

    If she consents while drunk and then regrets it when she's sobered up it's a bad decision. Not rape.

    I fucking hate feminists so much.

    For some awful reason, rape is legally a vague term where I'm from. There must be several reasons for all of this, but I think it is partly due to the expanding definitions proposed by concerned political individuals that its criminal status is rapidly dimishing in my country. When such a serious crime is being treated with judicial doubt, creating more sexual situations where women can press charges will only weaken the effect of a rape allegation, no matter how good the intent. It is important to protect the tangibility of the criminal act, instead of investigating consent in modern courting.

    No one ever said regret should ever be regarded under the same light as rape. What feminists are denouncing is people often framing rape victims as having buyer's regret.

    does that include the "she dressed the part/acted the part" as well as what could be regarded as regret. I get fired up when I read about people claiming a woman deserved what she got because she dressed the part of a loose woman or acted like a tramp. That kind of talk ends up making the rapist more the victim and that...well it really grinds my gears.

    Feminists do have a point with wanting to speak out against that kind of talk because [the talk] promotes a negative environment.

    I don't think Feminists should waste time protesting guys like Tucker Max and shouting from the rooftops that any pickups at bars/clubs/etc can fall into the rape category. Women do have to take some responsibility for their actions: go to a club and drink too much and you might do something you'll regret. Kind of comes with the territory.
